La Cour constitutionnelle de la République démocratique du Congo s’apprête à tourner (ou non) une page importante de son histoire. Ce jeudi 20 juin, les juges constitutionnels doivent élire leur nouveau président, à l’issue du mandat de trois ans du magistrat Dieudonné Kamuleta Badibanga. Mais cette échéance se tient dans un climat tendu, marqué par des dissensions internes rarement exposées.
Selon plusieurs sources concordantes au sein même de la haute juridiction, le président sortant, Kamuleta, fait face à une fronde grandissante. Plusieurs de ses collègues contestent son leadership, pointant son rôle jugé “partisan” dans la gestion de dossiers électoraux sensibles, notamment ceux issus des contentieux des élections générales de 2023.
Malgré ces critiques, Dieudonné Kamuleta n’a pas renoncé à briguer un second mandat. Son ambition de rester à la tête de la Cour divise profondément l’institution. En coulisses, des discussions serrées et des manœuvres d’alliances se multiplient pour éviter ce qui serait perçu, pour certains magistrats, comme une « confiscation de l’indépendance » de la Cour.
Cette élection revêt un enjeu crucial, tant pour la stabilité institutionnelle que pour l’image d’impartialité de la justice constitutionnelle congolaise. Le choix des juges ce jeudi pourrait être interprété comme un signal fort sur la capacité ou non de l’institution à se réformer de l’intérieur.
