Le Conseil de Madame Demomo Moolo Sandrine a saisi le Premier Président du Conseil d’État de la République Démocratique du Congo pour introduire la requête en correction d’erreur matérielle dans l’arrêt sous REA 335 et dénoncer avec force la violation manifeste de la loi observée par le refus d’enrôler une action en justice.
Ci-dessous, la requête du Conseil de Mme Sandrine
Conseil de Madame Sandrine Demomo avait bénéficié de l’arrêt de la Cour d’Appel du Sud Ubangi, la proclamant élue sur la liste LP à l’issue des élections du 20 décembre dernier; ses adversaires mécontents de cette décision avaient saisis le Conseil d’Etat sous REA 335, lequel conseil avait rendu une décision entaché d’irrégularités et dont le mode de signification laisse aussi à désirer :
Etant victime dans cet arrêt sous REA 335, elle a résolu de saisir le même Conseil d’Etat pour correction d’erreur matérielle, car convaincu que le Conseil d’Etat ne saurait prendre une telle décision s’il avait en main tous les éléments du dossier;
Mais contre tout entente et en violation des lois de la République, le greffe de contentieux électoraux s’est abstenu de recevoir la requête, au motif qu’ils n’ont pas reçu l’ordre de monsieur le directeur de cabinet au 3 étage de l’immeuble abritant le conseil d’Etat;
« Madame le Président, en nous rendant auprès de votre Directeur de cabinet en date de lundi 29 avril 2024, ce dernier nous avait demandé de passer le vendredi le 03 mai 2024 afin que notre requête soit enrole;
Malheureusement, on ne s’était pas rendu compte que c’était de la poudre aux yeux, parce que le directeur de cabinet n’avait pas toujours donne l’ordre que le greffe nous reçoive, et surtout que nous ne savons pas si le fonctionnement des greffes sont liés avec les directions de cabinet, en violation des lois de la république, notamment les articles 12, 19 et 21 alinéa 2-3 de la constitution du 18 fevrier 2006, l’article 32 du code procédure civile, etc….
- Article 12: Tous les congolais sont égaux devant la loi et ont droit a une égale protection de loi.
•Article 21 al.2-3 : le droit de former un recours contre un jugement est garantie & tous. - Il est exercé par les conditions fixées par la loi.
•Article 19: Toute personne a droit à ce que sa cause soit entendue dans un délai raisonnable par le juge compétent.
*Article 31: L’action est ouverte à tous ceux qui ont un intérêt légitime au succès + ou au rejet d’une prétention, sous réserve des cas dans lesquelles la loi attribue
« le droit d’agir aux seules personnes qu’elle qualifie pour élever ou combattre : une prétention ou pour défendre un intérêt déterminé.
il sied également de préciser • que dans un match de football, un arbitre ne joue jamais, peu importe son implication en faveur d’un camp… » ;
Madame le Premier Président, le comportement ci-haut décrié est de nature à bafouer votre autorité, vous étant les portes étendards de l’état de droit et les garants des droits et libertés fondamentaux.
C’est dans cette optique que ma cliente vous saisit pour dénoncer ce comportement discriminatoire, irresponsable et attitudes illégales que nous avons soulevés, nous empéchant d’initier notre action par devant votre haute juridiction contre l’arrêt sous REA 335.
Dans l’intime conviction que vous ferez droit à la requête de ma cliente, dans le souci de contribuer à l’Etat de Droits prôné par le Chef de l’Etat, et que ma cliente retrouvera sa quiétude en initiant son action tendant à obtenir la correction de l’erreur matérielle contenue dans l’arrêt sous REA335, du reste non encore signifié aux parties, nous vous prions de recevoir, Madame le Premier le Président, nos salutations distinguées
