Dans un communiqué rendu public par le Président de la Commission Africaine pour la Supervision des Élections ( CASA), Simaro Mbayo Ngongo, ce mercredi 27 septembre 2023, la CASA constate que, le Conseil Supérieur de l’Audiovisuel et de la Communication (CSAC) est incapable de sanctionner la RTNC et BOSOLO NA POLITIK, deux chaînes de télévision qui violent toutes les directives réglementaires en rapport avec la campagne électorale en République Démocratique du Congo.
Pourquoi se réveiller seulement pendant que le candidat Moïse Katumbi est en tournée politique en Province ?
En effet, la CASA est surprise de constater que le Conseil Supérieur de l’Audiovisuel (CSAC) s’illustre par un dirigisme réglementaires déséquilibrés.
Sur ce, elle regrette q’une institution d’appuie à la démocratie comme le CSAC puisse très aléatoirement emboîter le pas à la CENI, une institution estampillée violatrice des lois et des procédures de réglementation du processus électoral.

LA CAMPAGNE ÉLECTORALE PRÉCOCE : LE CSAC INCAPABLE DE SANCTIONNER LES MÉDIAS DU POUVOIR SE LANCE COMME LA CENI-KADIMA, DANS UNE MISE EN SCÈNE CREUSE D’AUTORITÉ POUR UNE SIMPLE PLAISANTERIE COMMUNICATIONNELLE DE FORME. LA CASE CONSTATE QUE LE CSAC EST INCAPABLE DE SANCTIONNER LA RTNC ET BOSOLO NA POLITIK, DEUX CHAÎNES DE TÉLÉVISION QUI VIOLENT TOUTES LES DIRECTIVES RÉGLEMENTAIRES.
POURQUOI SE RÉVEILLER SEULEMENT PENDANT QUE LE CANDIDAT MOÏSE KATUMBI EST EN TOURNÉE POLITIQUE EN PROVINCE ?
1. La CASE a été surprise de constater que le Conseil Supérieur de l’Audiovisuel et de la Communication (CSAC) s’illustre par un dirigisme règlementaire déséquilibré.
2. La CASE note que le CSAC excelle dans la curieuse habitude de ne se réveiller que lorsque les acteurs politiques de l’opposition se déploient politiquement. Placé comme la CENI-KADIMA sous la coupe du pouvoir, le CSAC ne se réunit sensationnellement que lorsqu’il s’agit soit de sanctionner des journalistes étiquetés proches de l’opposition ou alors pour mettre tous les médias en garde par rapport à la couverture médiatique des activités politiques de l’opposition.
3. La CASE constate non sans regret que le CSAC vient d’émettre un communiqué impromptu de rappel à l’ordre des médias nationaux sournoisement en raison de la tournée très mobilisatrice du candidat MOÏSE KATUMBI CHAPWE dans le Congo profond. Étant donné que le Président du parti politique ENSEMBLE POUR LA RÉPUBLIQUE est de plus en plus en hausse de popularité dans les provinces de l’Equateur, de l’ex-Bandundu, du Katanga et de l’Est de la RDC, le régime TSHISEKEDI qui a toujours ciblé les médias, journalistes et acteurs politiques proches dudit candidat, relance sa “machine à éteindre la démocratie” en vue de sanctionner et couper le signal aux rares médias encore proches du peuple.
4. La CASE regrette qu’une institution d’appui à la démocratie comme le CSAC puisse très aléatoirement emboîter le pas à la CENI, une institution estampillée violatrice des lois et des procédures de réglementation du processus électoral.
5. La Directive du Conseil Supérieur de l’Audiovisuel et de la Communication n°CSAC/AP/001/2015 du 05 mars 2015 relative à la campagne électorale à travers les médias indique précisément que (Article 2) conformément à l’article 11 de la Loi électorale, les campagnes électorales sont fixées par le calendrier arrêté par la CENI. De manière très décevante, le parti présidentiel (UDPS) et ses alliés de l’Union Sacrée font obligatoirement diffuser les éléments de reportage de leurs activités quotidiennes sur la RTNC sans aucune mise en garde ni sanction visibles. Il en est de même des débats excessifs orientés contre les groupes politiques de l’opposition qui sont tolérés aussi bien à la RTNC que sur la chaîne BOSOLO NA POLITIK.
6. Cette attitude anti-démocratique de deux poids deux mesures viole brillamment l’article 3 de la même directive qui stipule: “Pendant la période sus-indiquée, tous les médias sont astreints à observer une grande rigueur dans la collecte, le traitement, la programmation et la diffusion de l’information. A cet effet, ils sont tenus de respecter les textes légaux et réglementaires régissant la profession ainsi que l’éthique et la déontologie des journalistes congolais”. L’article 4 poursuit que : “Les médias doivent notamment en cette période : 1. S’interdire la diffusion des chansons, clips, jeux, spots, communiqués, proverbes, saynètes, écrits satiriques et caricatures qui sont de nature à inciter à la haine, à toutes les formes de discrimination ou à mettre en péril la cohésion nationale ; 2. Éviter la diffusion des résultats de sondages d’opinion 48 heures avant les scrutins “.
7. Toutes ces dispositions comme celles ayant trait à l’affichage des supports de campagne sont violées par les partis au pouvoir. “Durant la campagne électorale, l’apposition des affiches de propagande est autorisée sur les panneaux mis en place à cette fin sur l’ensemble du territoire national. Le démontage de ces panneaux doit intervenir sept (7) jours, au plus tard, après la clôture officielle de campagne électorale” (Article 54).
